GraphixFlow provides creative design and development services, including but not limited to web design, graphic design, logo design, UI/UX design, motion graphics, and SEO services. We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of our Services.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.

4. Payment Terms

By purchasing our Services, you agree to pay all fees and charges associated with your account on a timely basis and according to the payment terms specified in your service agreement or proposal.

4.1 Fees and Payment

All fees are quoted in the currency specified and are subject to change with notice. Payment must be made according to the payment schedule outlined in your service agreement or proposal. We accept various payment methods as specified on our website or in your agreement.

4.2 Refunds

Our refund policy will be specified in your service agreement or proposal. Generally, deposits are non-refundable once work has commenced. For subscription services, refunds may be provided on a pro-rata basis according to our refund policy.

5. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of GraphixFlow and its licensors. The Service is protected by copyright, trademark, and other laws.

5.1 Ownership of Deliverables

Upon full payment of all fees due, we will transfer to you all rights, title, and interest in the final deliverables as specified in your service agreement or proposal. This transfer does not include our working files, preliminary designs, or concepts not selected for final production unless explicitly stated in your agreement.

5.2 Our Use of Your Work

Unless otherwise specified in your agreement, we reserve the right to display and link to your completed project as part of our portfolio and to write about the project on websites, in magazine articles, and in books about design.

6. User Content

When you provide content to us for use in your project, you retain ownership of that content. By providing content to us, you grant us a license to use, reproduce, adapt, publish, and distribute that content solely for the purpose of providing our Services to you.

6.1 Content Restrictions

You agree not to provide content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
  • Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
  • Violates any law or regulation
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware

7. Prohibited Activities

You agree not to use our Services for any purpose that is unlawful or prohibited by these Terms. You may not use our Services in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of our Services.

8. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

8.1 Effects of Termination

Upon termination of your account, we may delete any files, content, or other information associated with your account. Any outstanding payment obligations will survive termination.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

In no event shall GraphixFlow, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

11. Indemnification

You agree to defend, indemnify, and hold harmless GraphixFlow and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes.
